1.2 We Are Not the Employer
American Trade Jobs is NOT the employer of candidates we place. We act solely as a staffing agency and recruiting intermediary. All employment relationships, including hiring decisions, compensation, benefits, work conditions, and termination, are between the candidate and the hiring employer.
We do not:
- Make final hiring decisions (employers do)
- Set pay rates or benefits (employers do)
- Control work schedules or assignments (employers do)
- Provide employment benefits (employers do)
- Guarantee continued employment (employers control this)
1.3 No Guarantee of Placement or Earnings
We make NO guarantees regarding:
- Job placement or hiring
- Specific pay rates or earnings
- Work hours, schedules, or assignments
- Duration of employment
- Benefits or perks
- Career advancement or promotions
All employment terms, including compensation, are determined solely by the hiring employer and may change at the employer’s discretion.
2. User Eligibility and Accounts
2.1 Age Requirement
You must be at least 18 years of age to use our Site or Services. By using our Site, you represent and warrant that you meet this age requirement.
2.2 Accurate Information
You agree to provide accurate, current, and complete information when:
- Submitting job applications
- Creating an account or profile
- Communicating with us or employers
- Providing certifications, licenses, or work history
Providing false, misleading, or fraudulent information is grounds for immediate termination of access and may result in legal action.
2.3 Account Security

3. Prohibited Conduct

- Receive no employee benefits from us
- Are compensated on a commission or fee basis
- Have no authority to bind American Trade Jobs to contracts or agreements
- Are not authorized to make promises or guarantees on our behalf
4.2 No Authority to Bind Company
Independent contractors and recruiters have NO authority to:
- Make employment offers on behalf of employers
- Guarantee specific pay rates, benefits, or work conditions
- Enter into binding agreements on behalf of American Trade Jobs
- Make promises or representations beyond what is stated in writing by authorized Company representatives
Any promises or representations made by unauthorized individuals are not binding on American Trade Jobs.
5. Suspension and Termination
5.1 Our Right to Suspend or Terminate
We reserve the right, in our sole discretion, to:
- Suspend or terminate your access to the Site or Services at any time
- Remove or refuse to post any content you submit
- Refuse service to anyone for any reason
- Modify or discontinue the Site or Services without notice
Grounds for suspension or termination include, but are not limited to:
- Violation of these Terms
- Providing false or fraudulent information
- Abusive or inappropriate behavior
- Failure to meet employer requirements or expectations
- Legal or regulatory concerns
- Business reasons or operational changes
5.2 Effect of Termination
Upon termination:
- Your right to access the Site and Services immediately ceases
- We may delete your account and data
- You remain liable for any obligations incurred prior to termination
- Sections of these Terms that by their nature should survive termination will survive
6. Disclaimers and Limitation of Liability

WE ARE NOT RESPONSIBLE FOR:
- Hiring decisions made by employers
- Pay rates, benefits, or work conditions set by employers
- Changes to employment terms by employers
- Termination of employment by employers
- Workplace safety or working conditions
- Employer compliance with labor laws
- Disputes between candidates and employers
6.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
AMERICAN TRADE JOBS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Lost profits or earnings
- Lost employment opportunities
- Business interruption
- Loss of data or information
- Cost of substitute services
- Personal injury or emotional distress
ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6.4 Cap on Liability
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
6.5 Indemnification
You agree to indemnify, defend, and hold harmless American Trade Jobs, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

- Your violation of these Terms
- Your violation of any rights of another party
- Your provision of false or misleading information
- Your employment relationship with any employer
7. Intellectual Property
